By checking the box, I acknowledge, accept, and agree that:
 

1. I acknowledge that participating in outdoor running activities carries inherent risks. These activities take place in the great outdoors, encompassing various terrains, which cannot be fully controlled or modified to eliminate all risks. Some potential risks include running on trails with unpredictable conditions such as dirt and grass. It is worth noting that even coaches and volunteers, despite exercising their judgment, may occasionally misjudge circumstances. Additionally, weather conditions can swiftly change, directly leading to injuries such as hail, lightning strikes, or sunburn. The combination of natural surroundings and weather during outdoor activities may pose hazards such as injury-causing elements like tree branches, falls, tripping, contact with insects or animals, unstable surfaces, rocks, dirt, and more.
 

2. I AGREE THAT MY CHILD AND I KNOWINGLY, FREELY, AND VOLUNTARILY ASSUME AND ACCEPT ALL SUCH RISKS, BOTH KNOWN AND UNKNOWN, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASES (as hereinafter defined) or others, and accept and assume full risk, responsibility and liability for my and/or my child's participation;
 

3. I, for myself and on behalf of my heirs, dependants, assigns, personal representatives and/or next of kin, forever WAIVE, RELEASE, DISCHARGE, and COVENANT NOT TO SUE, Mountain Movers Kids, Inc. d/b/a Mountain Movers, Colorado Parks and Wildlife, State of Colorado. and any of their respective officers, directors, representatives, board members, officials, agents and/or employees, affiliates, subsidiaries, and/or assigns, as well as their independent contractors, sponsoring agencies, sponsors, advertisers, and volunteers, (collectively, the "Releases"), WITH RESPECT TO ANY AND ALL INJURY, SUITS COSTS, LIABILITY, DISABILITY, DEATH, and/or loss or damage to person or property, ARISING IN CONNECTION WITH MY AND/OR MY CHILD/CHILDRENS PARTICIPATION, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASES OR OTHERWISE. I further agree to indemnify, defend and hold harmless Releases from any loss, liability, cost, claim or damages arising from my and/or my child/children participation in the trail race planned, recommended, organized and sponsored by the Releases or connected with the activities, including but not limited to, reasonable attorney’s fees;

 

4. MEDIA RELEASE: I hereby grant Mountain Movers Kids, Inc. the authorization to utilize any photographs or videos featuring myself and/or my child/children engaged in activities for promotional endeavors.

5. CONSENT: I grant consent for my child to participate in all activities, except for any limitations specified in the additional comments section of the sign-up form.

6. MEDICAL EMERGENCY: By agreeing to this, I acknowledge that if I and/or my child experiences a medical emergency and I cannot be contacted, it grants permission to the attending physician(s) for treatment with guaranteed payment. I am aware that Mountain Movers Kids, Inc. does not offer medical insurance and I will bear the responsibility for any medical expenses incurred.

7. STATE OF COLORADO: I agree that the law of the State of Colorado shall govern this document and all other aspects of my and my child's relationship with Mountain Movers Kids, Inc. and its agents and employees.

 

I HAVE READ THIS WAIVER, RELEASE OF LIABILITY, MEDIA RELEASE, ASSUMPTION OF RISK, AND COVENANT NOT TO SUE AGREEMENT, AND FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY.

 

I possess complete custody of this child and hold the authority to sign this agreement.
